Terms of Service

1. Scope
These terms govern the use of mcpfax.de between PIT Webservices GmbH, Austria ("Provider") and its customers. The service is offered exclusively to businesses; no contracts are concluded with consumers.
2. Service
The Provider enables sending outbound faxes worldwide via web interface, AI assistants (e.g. Claude, ChatGPT) using the Model Context Protocol, and API keys. Fax receiving is not offered. Transmission is performed via third-party carriers (in particular simple-fax.de); successful delivery cannot be guaranteed. Transmission reports are no legally binding proof of receipt.
3. Account
Credentials, API keys and AI assistant connections must be kept confidential. Every fax triggered through the account, an API key or a connected AI assistant is deemed to be initiated by the customer.
4. Prices and credits
Sending is charged in prepaid credits according to the price list. Prices are net plus VAT where applicable (reverse charge for valid EU VAT IDs outside Austria). The cost is shown before each fax. Credits for faxes that finally fail are refunded automatically. Credits do not expire while the account exists; no cash payout.
5. Customer obligations – no advertising
The customer is solely responsible for content and recipients, including faxes created or sent by an AI assistant on their behalf. Unsolicited advertising faxes and unlawful content are prohibited. Sending limits apply (50 faxes on the first day, doubling every following day). The Provider may block accounts immediately on reasonable suspicion of abuse. The customer indemnifies the Provider against third-party claims arising from misuse.
6. Liability
The Provider is liable only for intent and gross negligence (except personal injury), limited to the fees paid in the last twelve months. Liability for lost profits, consequential damages and missed deadlines is excluded.
7. Data retention
Fax documents are deleted automatically after 30 days. See the privacy policy.
8. Term, changes, law
Indefinite term, terminable at any time by e-mail. Changes are announced four weeks in advance. Austrian law applies; place of jurisdiction is Vienna (Inner City).
